Photography Terms and Conditions

1. Deposit and Payment. The Client shall make a 25% or more deposit to retain Tetrad Opus to perform the services specified herein. The remaining 75% or greater is due 30 days prior to the date of services. If your session is scheduled within 30 days of this contract then the full amount is due. If you choose a payment plan then all payments are due by the due date given by Customer Service. We allow a 7 day grace period after which we will cancel the session to accept another client and the deposit is non-refundable.
2. Cancellation.  All deposits are non-refundable. The balance can be refunded if canceled at least 14 days in advance of the photo shoot scheduled date. We will attempt to reschedule the session if possible to avoid you loosing the deposit and if you can not reschedule we can refund the balance but the 25% deposit is non-refundable. No exceptions.
3. Covid-19 Protocol. If any team member of Tetrad Opus Photography Services contracts Covid-19 we will immediately inform you the client. We ask that if you or anyone in your party contracts Covid-19 to please inform us. Tetrad Opus Photography will NOT cancel the session but instead we will postpone until you or our team member is better and finished with quarantine. We are not responsible for loosing money/bookings with Makeup Artist, Hair Stylist or any other third party booking. We resume responsibility for Tetrad Opus Services which includes our Makeup Artist and Photography only. If you can not shoot on another date we will issue you a credit for the amount that you invested with Tetrad Opus Photography Services only.
4. Photographic Materials. All photographic material is the exclusive property of Tetrad Opus. Client will receive the exclusive Copyrights upon complete purchase (100%). Tetrad Opus will not use this photographic material without the prior permission of the client once Copyrights have been purchased by the client.
5. Images/Editing. All images are provided in Hi-Res JPEG, RAW Images are NOT released to the client unless purchased for $7.00 per photo. RAW
images are deleted within 30 days after your photos are captured so this request is time sensitive. All Photos will receive Traditional Editing at no additional
cost. If you would like Master Retouching the cost is $10.00 per photo and if there are more than one person in the photo that needs Master Retouching the
cost is $20 per photo.
6. Digital Backgrounds. Digital Backgrounds are not included in every session. We may offer one FREE Digital Background for Newborn Sessions, every additional image
including a digital background will cost $15.00 per photo.
7. Downloadable Link. All images are provided within 30 days of the session on a Downloadable link via Pixiset. This link will remain
active for 14 Days before inactivating the link. Please download your images before the expiration date after which there is a $25.00 reactivation fee.
8. Failure to Perform. If Tetrad Opus cannot perform this Agreement due to a fire or other casualty, strike, Quarantine, act of God, or other cause
beyond the control of the parties, or due to the Photographer’s illness, then Tetrad Opus shall return the deposit to the Client but shall have no further
liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost
through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Tetrad Opus. In the event Tetrad Opus fails to
perform for any other reason, Tetrad Opus shall not be liable for any amount in excess of the retail value of the Client’s order.
9. Inherent Qualities. Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client
releases Tetrad Opus from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
10. Tetrad Opus’s Standard Price List. The charges in this Agreement are based on the Tetrad Opus’s Standard Price List. This price list is adjusted
periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
11. Arbitration. All disputes arising under Agreement shall be submitted to binding arbitration within 30 days of the completed work in Anne Arundel
County or nearby counties and the arbitration award may be entered for judgment in any court having jurisdiction thereof. Notwithstanding the foregoing,
either party may refuse to arbitrate when the dispute is for a sum less than $500.00.
12. Discounts and Coupons. All Discounts and Coupons must be applied prior to the bill of sale. No exceptions.
13. Refunds. If services are rendered, refunds are not awarded due to the Time, Skill, Mileage and other cost associated with Photography. If the Client is unsatisfied with the
outcome of services Tetrad Opus will attempt to fix the issues with another Photo Shoot or Company Credit. No exceptions.
14. Miscellaneous. This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and
signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same
provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the State of Maryland.
